The TUPE Regulations give you very important rights at work when your company has been taken over or the contract you are working on changes hands.
It could be that your employer is merging or being acquired by another company or that your employers are going into insolvency.
In these situations, employers are aften given information and documentation full of complicated legal jargon and in other cases, sufficient information is not given to employees about the consequences of any transfer and the effect it will have on each employee. The TUPE Regulations protect employees from losing their employment in these types of situations and make sure that they retain their employment rights.
Our Employment Solicitors have many years of experience between them in dealing with these situations, have dealt with transfers involving small companies with only a few employees to large scale transfers involving hundreds or even thousands of employees.
A number of Trade Unions specifically use OH Parsons for advice in these areas because of our specialist knowledge.
TUPE stands for the Transfer of Undertakings (Protection of Employment) Regulations.
These give employees rights when their employers are being bought out by new companies or when the contract that they are working on changes hands.
It gives an employee the right to be consulted about the changes both in writing and in person and enhances rights not to be dismissed because of the transfer.
There are two main kinds of TUPE transfers:-
Business Transfers – this is where an entire business changes ownership, the emp0loyers of the seller business become the employees of the buyer business so long as the regulations apply.
Service Provision Changes – this is when a company transfers services between different contractors outsourcing a service from one contractor to another or bringing services back in the house. This is independent of the supply of goods for short term work or one-off events.
