Spencer studied law at Lancaster University and qualified as a Solicitor in 1995.
Spencer is the Senior Partner at OH Parsons and Head of the Employment Department. He specialises in employment rights and employment litigation.
He has acted for clients from a whole range of industries including aviation, construction, distribution and warehousing, retail, professional drivers, healthcare professionals, charities in the third sector, manufacturing, administration and managerial roles.
Spencer has many years’ experience of running employment claims and employment litigation for employees. O H Parsons never act for employers. He has worked both for trade union members and for clients who are not in any union.
Represented the Applicant in the case that was the first to set out the definition of a worker at the Employment Appeal Tribunal (Hedley Byrne & Co Limited -v- Heller & Partners Limited).
Acted for the Applicant in the Court of Appeal in a case that decided how the Transfer of Undertaking Regulations would affect employees who had had accidents at work (Bernadone -v- (1) Pall Mall Services Group (2) Haringey Healthcare NHS Trust).
Ran the “Blacklisting Litigation” acting for over 200 construction workers in a very large piece of High Court litigation against over 40 construction companies who had blacklisted their former employees.
Brought claims for misuse of private information, breach of data protection, defamation and libel and secured over £10 million in compensation for his clients.
Acting for the Claimant in a case that is clarifying the law on the issue of part-time workers receiving less favourable treatment by their employers (Pinaud -v- British Airways Plc) which has been to the Employment Appeal Tribunal and the Court of Appeal.
Involved in several other large scale pieces of litigation relating to underpayment and non-payment of holiday pay including a claim against British Airways Plc where he is representing over 20,000 members of Unite.
During his 25 years at OH Parsons Spencer has secured over £25 million in compensation for employees.
Spencer is a member of the Executive Committee of the Institute of Employment Rights and is a member of the Employment Lawyers Association.
