A self employed brick layer suffered various injuries including lacerations to his head and elbow when the scaffolding he was working on collapsed. The most significant injury was to his left shoulder which required surgery. He did not return to work after the accident and continued to suffer symptoms. A claim was made against the contractor responsible for the scaffolding on site and the principal contractor charged with overall safety on site. Both Defendants denied responsibility for the accident and court proceedings were brought against them both and they continued to blame each other for the accident. Before the hearing, a settlement was reached and both Defendant’s agreed to contribute to the bricklayers compensation.
A bus driver was involved in a serious road traffic accident on his way to work, when he was hit in the rear by a lorry. The Defendant agreed responsibility and to fund his private rehabilitation. He suffered a very severe fracture dislocation of the ankle requiring two operations, fractured wrist with permanent loss of grip, dental injuries and post traumatic stress disorder. His symptoms and treatment continued so court proceedings were commenced. He was unable to return to work as a driver and settlement was agreed to include future treatment costs including a foot fusion, brace, therapy but more importantly to cover his care, loss of earnings and pension.
